Terms and Conditions

Version: 21 September 2026

These terms apply to every tour operated by Walkie Talkie Tours.

Part A applies to all tours. Part B covers our free walking tours. Part C covers private and group tours booked directly with us at an agreed price. Part D covers bookings made through third-party platforms. Part E applies to all tours again.

Part A — General

1. Who we are

These terms apply to every tour booked with Carlos Iglesias Hernández, NIF 54477272R, trading as Walkie Talkie Tours, Av. de la Constitución 6, oficina 57, 29631 Arroyo de la Miel, Benalmádena, Málaga, Spain. Email: info@walkietalkietours.com

“We” and “us” mean Walkie Talkie Tours. “You” means the person or organisation making the booking. By making or confirming a booking you accept these terms on behalf of everyone in your group.

2. What we offer

We operate guided walking tours in Málaga. Some are free tours, which carry no fixed price. Others are private or group tours at a price agreed in advance. Tour content, routes, duration and meeting points are described at the time of booking and may be adjusted to reflect seasonal conditions, site access or operational needs.

3. Mixed groups

Participants on the same tour may have booked under different arrangements. Some will have agreed and paid a fixed price in advance, whether directly with us or through a third-party platform. Others will have joined on our free tour basis and will decide at the end what to contribute.

Everyone on a tour receives the same tour, from the same guide, along the same route. Which of the parts below applies to you depends on how you booked, not on how the tour is run.

Part B — Free walking tours

4. What “free” means

Our free walking tours have no fixed price and nothing is paid in advance. At the end of the tour you decide what the experience was worth to you and contribute that amount. There is no minimum, no suggested figure is required of you, and you are free to contribute nothing.

Contributions fund the running of our tours, including the pay of the guide who led yours.

Where a free tour includes a visit inside a monument such as the Alcazaba, the entry fee is not included. Participants buy their own tickets, either with the guide before the tour starts or in advance.

5. Booking and arrival

Booking is not required but is strongly recommended, so we know how large the group will be and can plan accordingly.

Please be at the meeting point by the advertised start time. Tours begin punctually, and from the start time we may reallocate booked places to people waiting to join. A booked place does not guarantee entry after the tour has begun.

6. Minimum numbers

A free tour runs with a minimum of five participants. If fewer than five people are present at the start time, we may cancel the tour. Where that happens we will offer you a place on another tour, and your guide will in any case answer your questions and suggest what to see.

Because nothing is paid in advance, no refund arises if a free tour is cancelled or if you do not attend.

Part C — Private and group tours at an agreed price

7. Bookings and confirmation

We hold your date provisionally as soon as we confirm it in writing. The booking becomes firm when we receive the deposit, or the full payment where you have chosen to pay in one instalment. Until then the date may be offered to another client.

8. Prices and what is included

Prices are per person, as set out in your written quotation, and depend on the size of the group and the tours chosen.

Every tour includes a qualified guide. Where a tour visits the Alcazaba and the Roman Theatre, entry tickets are included and are booked by us.

Prices include VAT. Transport, food and drink, gratuities and anything not expressly listed in the quotation are not included.

9. Group size and final numbers

Each tour has a minimum number of participants for the agreed price to apply, and a maximum set by the monuments and by what can be guided well in one group. Both are stated in your quotation.

Please confirm your final number in writing at least 14 days before the tour. That number is what we invoice, whether or not everyone in the group attends on the day.

If the minimum is not reached by then, we will offer you the price that applies to the smaller group, an alternative date, or cancellation with a full refund.

Extra participants can usually be added after that point, but only where entry tickets and guide capacity allow.

10. Payment

A deposit of 25% of the total price secures the date. The balance is invoiced and payable by bank transfer or payment link before the tour.

If you prefer, you may pay the full amount at the time of booking instead of a deposit. This is often the case for company bookings.

We may release a booking if payment is not received by the agreed date.

11. Changes and cancellation by you

All cancellations and date changes must be made in writing to info@walkietalkietours.com. The date we receive your written notice is the date we apply.

More than 14 days before the tour. We refund everything you have paid in full. Alternatively we can hold the amount towards a later provisional date, subject to availability.

14 days to 48 hours before the tour. We retain 25% of the total price. No further amount is payable, and where you have already paid in full we refund the balance above 25%.

Less than 48 hours before the tour, and no-shows. The full price for the confirmed number of participants is payable and no refund is due. A no-show means a group that does not arrive at the meeting point, or that has not contacted us within 15 minutes of the agreed start time.

Entry tickets already issued. Where monument tickets have been booked and cannot be cancelled or transferred, their cost is retained in addition to the amounts above. We will tell you the amount and provide the supporting documentation.

Date changes are treated as a cancellation and a new booking where they are requested less than 48 hours before the tour.

12. Right of withdrawal

In accordance with Article 103.l) of Royal Legislative Decree 1/2007 (TRLGDCU), the 14-day right of withdrawal does not apply to contracts for leisure services which the trader undertakes to provide on a specific date or during a specific period.

Our tours are provided on a specific agreed date. Bookings are therefore not subject to a statutory cooling-off period, and cancellations are governed exclusively by Section 11 above.

13. Cancellation by us

We cancel only in exceptional circumstances, such as illness with no guide available, or closure of the monuments. If that happens you may choose an alternative date or a full refund of everything you have paid. Our responsibility is limited to that amount.

Part D — Bookings through third-party platforms

14. Platform bookings

Our tours can also be booked through platforms such as GuruWalk, FreeTour, GetYourGuide, Civitatis, Headout, TripAdvisor and Google.

Where you book through one of these, that platform’s own terms, cancellation policy and payment processing apply to your booking in addition to these terms. Where there is a conflict specifically about payment or refund handling, the platform’s policy governs that aspect. Everything else in these terms continues to apply.

Part E — Applies to all tours

15. Meeting point and timing

The meeting point and start time are confirmed before the tour. Your guide will be at the meeting point in advance of the start time.

Where we have booked entry to the Alcazaba or the Roman Theatre for your group, entry is for a fixed time slot that cannot be moved, so tours begin punctually. A group arriving late may lose part of the visit, and no refund or extension is due in that case. Where a price was agreed in advance, a group that has not arrived or made contact within 15 minutes of the start time is treated as a no-show under Section 11.

16. Accessibility, health and minors

Our tours are walking tours through city streets and historic monuments. Surfaces are often cobbled or uneven and some routes include slopes and steps.

Please tell us when you book about any reduced mobility, medical condition or other requirement within the group. We will adapt the route where we can and tell you honestly where we cannot.

Comfortable footwear, water and sun protection are recommended. Participants under 18 must be accompanied by a responsible adult, who remains responsible for them throughout the tour.

17. Behaviour and safety

Participants follow the guide’s instructions and the rules of each monument at all times. We may ask anyone whose behaviour is unsafe, disruptive or disrespectful to leave the tour, and no refund is due in that case.

Leaving the group or interrupting the tour does not entitle you to a refund.

18. Liability

We are not responsible for personal belongings, or for injury or loss caused by a failure to follow the guide’s instructions or the rules of a site.

We recommend that all participants hold their own travel and medical insurance. Nothing in these terms limits any liability that cannot be limited under Spanish law.

19. Events beyond our control

Tours run in most weather. If severe weather, strikes, official closures or other events outside our control prevent a tour from going ahead, we will adapt the route where possible, or offer an alternative date or, for prepaid tours, a refund.

20. Photographs

Our guides sometimes take photographs or video during tours for use on our website and social media. Your guide will ask the group before doing so, and you may decline at any time, before or during the tour, with no effect on your participation.

We will not publish an image in which you are individually identifiable unless you have agreed. You may ask us to remove a specific image at any time by writing to info@walkietalkietours.com.

21. Intellectual property

The content of our website, our tour itineraries, our logo and the Walkie Talkie Tours name are our property and may not be reproduced or used without our prior written consent.

22. Personal data

We use the personal data you give us to manage your booking and to contact you about your tour. We keep it only as long as necessary and in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish data protection law.

Full details, including your rights and how to exercise them, are in our Privacy Policy at walkietalkietours.com/privacy-policy.

23. Complaints and applicable law

If something goes wrong, please tell your guide straight away so we can put it right, and write to us at info@walkietalkietours.com within 14 days of the tour.

Official complaint forms (hojas de quejas y reclamaciones) are available on request. You may also submit a complaint to the Servicio de Consumo of the Junta de Andalucía, to your local Oficina Municipal de Información al Consumidor (OMIC), or through the Sistema Arbitral de Consumo.

These terms are governed by Spanish law. Any dispute will be heard by the courts of Málaga, without prejudice to any mandatory right you may have as a consumer resident in another EU Member State to bring proceedings in your own country.

24. Changes to these terms

We may update these terms from time to time. The version in force is the one published on our website at the time of your booking.
