1. Who We Are

These Terms and Conditions apply to the website walkietalkietours.com, owned by Carlos Iglesias Hernández (trading name: Walkie Talkie Tours). Contact: info@walkietalkietours.com

By booking a tour with us — whether directly through our website, or through a third-party platform such as GuruWalk, FreeTour, TripAdvisor, GetYourGuide, Civitatis, or Google — you agree to be bound by these Terms.

2. Our Services

Walkie Talkie Tours offers walking tours and related activities in Málaga’s historic centre, including but not limited to:

Historic Centre Free Tour
Alcazaba & Roman Theatre Free Tour
Mysteries & Legends Free Tour
Private Tours (customised itineraries)
Tapas Tour

Tour content, routes, duration, and meeting points are described on the relevant booking page and may be updated from time to time to reflect seasonal conditions, site access, or operational needs.

3. Bookings
3.1 Direct bookings

Tours can be booked through our website’s booking calendar. You will receive a confirmation with the date, time, meeting point, and guide contact details.

3.2 Third-party platform bookings

Tours may also be booked via GuruWalk, FreeTour, TripAdvisor, GetYourGuide, Civitatis, or Google. When you book through one of these platforms, that platform’s own terms, cancellation policy, and payment processing also apply to your booking, in addition to these Terms. In the event of a conflict specifically about payment or refund handling, the third-party platform’s policy will govern that aspect of the transaction.

3.3 Accuracy of information

You are responsible for providing accurate contact information (name, email, phone) at the time of booking so we can reach you regarding any changes to your tour.

4. Pricing and Payment
4.1 Free tours

Our free tours operate on a “pay-what-you-wish” (tips-based) model. There is no fixed upfront fee; guests are asked to tip the guide at the end of the tour based on their experience. This is not optional in the sense of being a hidden mandatory charge — it is the way our guides are compensated, and is disclosed clearly at time of booking.

4.2 Paid tours (Private Tours, Tapas Tour, and others)

Prices for paid tours are shown at the time of booking and are inclusive of applicable taxes unless stated otherwise. Full or partial payment may be required at the time of booking depending on the tour and booking channel.

5. Cancellations, No-Shows, and Changes
5.1 Cancellation by you
Free tours: You may cancel your reservation at no charge before the scheduled start time via the booking confirmation link or by contacting us.

Tapas Tour: Cancellations made more than 48 hours before the tour start time will receive a full refund. Cancellations made within 48 hours of the start time are non-refundable.
Private tours: Cancellations are non-refundable.

If booked via a third-party platform, that platform’s cancellation policy applies.
5.2 No-shows

If you do not arrive at the meeting point within 15 minutes of the scheduled start time and have not contacted us, your booking will be treated as a no-show and, for paid tours, no refund will be issued.

5.3 Cancellation or changes by us

We reserve the right to cancel, postpone, or modify a tour due to insufficient bookings, adverse weather, safety concerns, site closures, or other circumstances beyond our control (see Section 8, Force Majeure). Where we cancel a tour, you will be offered a full refund (for paid tours) or the option to rebook.

6. Conduct and Participation
Guests are expected to arrive on time and follow the guide’s reasonable instructions during the tour, particularly regarding safety, road crossings, and site rules.
We reserve the right to refuse participation, or to remove a guest from a tour without refund, in cases of intoxication, aggressive behaviour, or conduct that endangers the group or the guide.
Tours involve walking on uneven historic terrain, stairs, and outdoor conditions. Please ensure you are physically able to participate and wear appropriate footwear.
7. Liability and Assumption of Risk
Participation in our tours involves inherent risks associated with walking in an outdoor, historic urban environment (uneven surfaces, traffic, weather, crowds).
To the maximum extent permitted by Spanish law, Walkie Talkie Tours is not liable for personal injury, loss, or damage to belongings arising from your participation in a tour, except where such liability arises from our negligence or that of our guides.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under Spanish or EU consumer protection law.
We strongly recommend guests hold their own travel insurance.
8. Force Majeure

We are not liable for failure to perform our obligations where this is due to circumstances beyond our reasonable control, including but not limited to extreme weather, public health restrictions, strikes, or closures of public monuments or sites included in the tour route.

9. Photography and Image Rights

During tours, our guides may take photographs or videos for use in our marketing materials, website, and social media (including @walkie.talkie.tours on Instagram or Facebook). By participating in a tour, you consent to the possibility of appearing in such content, unless you inform your guide at the start of the tour that you do not wish to be photographed. You may request removal of a specific image by contacting us at info@walkietalkietours.com.

10. Intellectual Property

All content on the Walkie Talkie Tours website — including text, tour itineraries, logos, and the Walkie Talkie Tours name and trademark — is the property of Walkie Talkie Tours and may not be reproduced or used without our prior written consent.

11. Reviews and Ratings

We value honest feedback on GuruWalk, FreeTour, TripAdvisor, GetYourGuide, Civitatis, and Google. Reviews should reflect your genuine experience; we do not offer incentives in exchange for positive reviews.

12. Governing Law and Jurisdiction

These Terms are governed by Spanish law. Any dispute arising from these Terms or your use of our services will be submitted to the courts of Málaga, Spain, without prejudice to any mandatory consumer protection rights you may have to bring proceedings in your own country of residence if you are an EU consumer.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. The version in force is the one published on our website at the time of your booking.
